Overview
Welcome to Madelief Explores. In these terms and conditions, “we”, “us” and “our” refer to Madelief Explores. We operate this online store and website, including all associated information, content, features, tools, products and services (hereinafter: the “Services”).
The online store is technically powered by Shopify. This enables us to offer our products to you.
These General Terms and Conditions describe your rights and obligations when using our Services and apply to all agreements we enter into through the online store. Please read them carefully.
By visiting or using our website or making a purchase, you agree to these General Terms and Conditions and our Privacy Policy. If you do not agree with them, we ask you not to use our Services.

We are registered with the Dutch Chamber of Commerce. We are registered as the controller for the processing of personal data in accordance with the GDPR.
Article 2 - Access and Use
By using this website, you declare that you are at least 18 years old, or that you have permission from a legal representative.
To place an order, you provide information such as your name, email address, delivery address and payment information. You declare that all information provided is correct, complete and up to date.
You are responsible for securing your account details and for all activities that take place through your account. Do not share your login details with third parties.
Article 3 - Our Products
Madelief Explores sells handmade dog products, including leashes and collars. Each product is made by hand and may therefore differ from the product photo in small details. These are not defects, but a characteristic of handmade products.
We make every effort to describe and display products as accurately as possible. Product descriptions may be amended at any time. We reserve the right to change or remove products or limit their availability.
Handmade versus personalised: standard handmade products are not the same as customised products. Only products that we specifically personalise at your request, for example with a name or adjusted size, are considered customised products. This distinction is relevant to the right of withdrawal, see Article 7.
Article 4 - Orders and Agreement
When you place an order, you make an offer to purchase. The agreement is concluded as soon as we confirm your order in writing, by email, and the payment has been successfully processed.
Check your order carefully before completing it. After confirmation, an ongoing production process cannot always be stopped, but your statutory right of withdrawal remains fully applicable, see Article 7.
Purchases are intended for personal use and may not be resold without our written permission.
We reserve the right to refuse or cancel an order, for example in the event of suspected fraud, incorrect information or if a product is no longer available. In that case, you will be informed as soon as possible and will receive a full refund.
Article 5 - Prices and Payment
All prices are stated in euros and include VAT, unless expressly stated otherwise. Shipping costs are stated separately at checkout.
We reserve the right to change prices. The price applicable at the time of ordering is the price stated in the order confirmation and is binding for that order.

You declare that you are authorised to use the chosen payment method. If we suspect fraudulent payments, we reserve the right to cancel an order.
Obvious pricing errors, for example as a result of a technical error, are not binding. We will inform you of this as soon as possible and offer you the choice of continuing the order at the correct price or cancelling it free of charge.
Article 6 - Delivery
We only supply physical products. After confirmation of your payment, we prepare your order for shipment.
Delivery Time
We aim to ship orders within 3 to 7 working days, unless a different period is stated on the product page. Personalised or made-to-measure products may have a longer production time; this will always be stated in advance.
If we are unable to deliver an order within the stated period, we will inform you as soon as possible. You then have the right to cancel the order free of charge and receive a full refund.
Shipping
Orders are sent via a carrier chosen by us, for example PostNL or DHL. As soon as your order has been shipped, you will receive a track & trace code from us.
The risk of damage to or loss of the product passes to you at the moment the carrier takes possession of the package. In the event of demonstrable damage or loss during transport, please contact us as soon as possible via info@madelief-explores.com.
Undelivered Packages
If your package has not been received after the expected delivery time, please contact us. We will take action with the carrier. If a package has demonstrably been lost, we will send a replacement or issue a refund.
Article 7 - Right of Withdrawal
As a consumer, under European consumer law, Directive 2011/83/EU, you have the right to withdraw from an online purchase within 14 calendar days without giving a reason. The withdrawal period begins on the day after you have received the product.
For the precise conditions, exceptions, such as personalised products, return instructions and refund rules, we refer you to our Returns and Refund Policy, which forms an integral part of these General Terms and Conditions.
The right of withdrawal also applies to sale products. Discounts or offers do not affect your statutory rights as a consumer.
Article 8 - Conformity and Statutory Warranty
Pursuant to Article 7:17 of the Dutch Civil Code, you are protected as a consumer by the statutory conformity obligation. This means that the product must meet what may reasonably be expected under the purchase agreement.
If a product has a defect resulting from material or manufacturing faults, you are entitled to:
• Repair or replacement of the product
• A price reduction, or
• Termination of the agreement with a refund of the purchase price
In the event of defects, please contact us as soon as possible via info@madelief-explores.com, no later than two months after you discovered the defect. Defects caused by incorrect use, wear and tear through use or damage caused by the buyer are not covered by this warranty.
We are legally required to supply products that comply with the agreement. We do not exclude the statutory conformity obligation. Any clause contrary to this is void.
Article 9 - Intellectual Property
All content on this website, including texts, designs, images, logos, product photographs and other materials, is the property of Madelief Explores or its licensors, unless expressly stated otherwise.
It is not permitted to copy, reproduce, distribute, publish or commercially use this content without our prior written permission.
The purchase of a product does not grant you any intellectual property rights to the associated designs, patterns or creations.
Article 10 - Privacy
We process your personal data in accordance with our Privacy Policy, which forms an integral part of these General Terms and Conditions. Because our online store is hosted through Shopify, Shopify processes certain data on our behalf or as an independent controller.

Article 11 - Feedback and Reviews
If you voluntarily share feedback, reviews or other content with us through our website or social media, Madelief Explores may use it for informational and promotional purposes, provided that your name or other identifying information is only used if you have expressly given permission for this.
You declare that your feedback and content do not infringe the rights of third parties and do not contain offensive, discriminatory or misleading content. We reserve the right to remove content without giving a reason.
Article 12 - External Tools and Links
Our website may contain references or links to third-party websites, tools or services. We have no control over these external parties and are not liable for their content, services or privacy practices.
Use of external websites and tools is entirely at your own risk. We recommend that you read the privacy policy and general terms and conditions of these parties.
Article 13 - Prohibited Use
It is not permitted to use our website or Services for:
• Unlawful or fraudulent purposes
• Infringing our intellectual property rights or those of third parties
• Distributing harmful software, viruses or other malicious code
• Disrupting the operation or security of the website
• Collecting personal data from other users without permission
If these provisions are violated, we reserve the right to block your access to the website and, where applicable, take legal action.
Article 14 - Liability
To the extent permitted by law, Madelief Explores is not liable for indirect damage, consequential damage, loss of profit or loss of data arising from the use of our Services.
Our liability for direct damage is in all cases limited to the amount you paid for the relevant order.
We expressly do not exclude liability for death or personal injury caused by our negligence. Such an exclusion is void pursuant to Article 6:237(f) of the Dutch Civil Code.
Use of our products, including dog leashes and collars, during outdoor activities or in situations involving a risk of injury is at your own risk. We are not liable for damage to persons or animals resulting from incorrect use of our products.
Article 15 - Force Majeure
We are not liable for delays or failure to fulfil our obligations as a result of circumstances beyond our reasonable control, such as strikes, extreme weather conditions, pandemics, disruptions involving carriers or suppliers, or government measures.
In the event of force majeure, we will inform you as soon as possible and seek a reasonable solution, such as postponement of delivery or a refund.
Article 16 - Complaints and Disputes
Complaints
If you have a complaint about a product or our services, please first contact us via info@madelief-explores.com. We aim to handle complaints within 5 working days.
Applicable Law
These General Terms and Conditions and all agreements concluded through our online store are governed exclusively by Dutch law.
Dispute Resolution
Disputes will preferably be resolved by mutual agreement. If this is not possible, the Dutch courts and the competent court in the district of North Holland shall have exclusive jurisdiction.
As a consumer in the EU, you also have the option to submit a complaint through the European ODR platform, Online Dispute Resolution: ec.europa.eu/consumers/odr.
Article 17 - Changes
We reserve the right to amend these General Terms and Conditions at any time. The most recent version is always available on our website. The “Version” date at the top of this document indicates the most recent version.
We will announce materially important changes through our website. For ongoing agreements, the terms and conditions that were in force at the time of the order apply.
